Social Media and Privacy: Current Topics

A presentation on the status of privacy law and case law as it relates to use of social media within the employment relationship.
DRM Burlington Attorney Matthew Borick presented a program to the New England-based Tri State Defense Lawyers Association on the status of privacy law and case law as it relates to use of social media within the employment relationship. Borick’s presentation, Social Media and Privacy: Current Topics, was presented as a webinar for lawyer members on May 30.
According to Borick, more and more states are enacting laws dealing with the privacy rights of users of such social media sites as Facebook, Linked In, and Twitter, as well as the proliferation of blogs written by individual users but available to the on-line public. Meanwhile, courts around the country are considering issues raised by the use of social media in both personal and professional contexts.
A major focus of current legislative and judicial involvement, particularly in the states of Maine, New Hampshire and Vermont, are decisions regarding password privacy. While it is generally understood that an employer owns the rights to programs its employees use and data stored in the workplace, the relationship between personal rights and employer rights to information contained in third-party public programs is less clear.
Borick, a litigation lawyer, focuses his practice in the areas of intellectual property, commercial disputes, computer crimes, privacy and cyberlaw, and insurance coverage. He graduated first-in-class from the University of New Hampshire School of Law in 2003 and joined DRM the same year. He was named a director of the firm in 2011. A Phi Beta Kappa graduate of Dickinson College, Borick also earned a master’s degree from Northwestern University.
Borick is a member of the Defense Research Institute and the Vermont vice president of the Tri-State Defense Lawyers Association. A member of the 2007 class of the Leadership Champlain Program sponsored by the Lake Champlain Regional Chamber of Commerce, Borick is also a member of the board of directors and coach for South Burlington Youth Baseball & Softball.
